kinnly Terms of Service

Welcome to kinnly! These Terms of Service ("Terms") govern your access to and use of the kinnly mobile application and related services (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

1. Description of Service

kinnly is a co-parenting application designed to help two households coordinate custody schedules, share milestones, split expenses, secure documents, and communicate. Add-on tiers (including kinnly court) may be available depending on your subscription.

2. Eligibility & Accounts

• Age: You must be at least 18 years old to create an account and use the Services.
• Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
• Family Linkage: kinnly is designed to link two co-parenting households. When you invite a co-parent (or accept an invite), you consent to sharing the family data described in the Privacy Policy with that linked co-parent.

3. Subscriptions & Billing

A. Plans

kinnly's current subscription structure is:

• kinnly: available monthly or annually. Unlocks the full kinnly feature set including family chat, medication tracker, video journal entries, shared lists, and hugs.
• kinnly court add-on: an additional subscription that attaches to a kinnly subscription. Unlocks court-usable logs, extended history retention, therapist access controls, priority support, and legal metadata.

One subscription per family. A single kinnly subscription covers your entire family — both linked co-parenting households and every Family Circle member you invite (grandparents, nannies, godparents, and other approved caregivers). Only one parent needs to subscribe to unlock kinnly for everyone in the family. There is no per-user or per-household charge.

Plan details, current pricing, and available promotions are shown in the app before you subscribe. We may change plan pricing or the features included in each plan; changes to your existing subscription price will be communicated in advance per platform requirements.

B. Free Trial

New subscribers receive a 7-day free trial of kinnly. You will not be charged during the trial. To avoid being charged, cancel before the trial ends (see Cancellation below).

C. Billing & Auto-Renewal

Subscriptions are billed on a recurring monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged for the renewal at the then-current price plus any applicable taxes.

Billing is processed securely through our partners: Stripe (for our web/backend flows) and RevenueCat via the Apple App Store or Google Play Store (for in-app purchases made on iOS or Android devices).

D. Cancellation

How to cancel depends on where you subscribed:

• iOS (App Store): Manage or cancel through your device's Settings → Apple ID → Subscriptions.
• Android (Play Store): Manage or cancel through Google Play → Payments & subscriptions → Subscriptions.
• Web / Stripe: Manage or cancel through the Stripe billing portal accessible from kinnly's in-app settings.

Access to paid features will continue until the end of your current billing period. Refunds for partial subscription periods are handled by the platform of purchase (Apple, Google, or Stripe) per their respective refund policies; kinnly does not directly issue refunds for platform-billed subscriptions.

4. Prohibited Uses

You agree not to use the Services to:

• Upload, post, or transmit any content that is illegal, defamatory, abusive, harassing, threatening, or harmful to minors.
• Use the Services to stalk, harass, or intimidate your co-parent or any other person.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Upload files containing viruses, Trojan horses, worms, or any other malicious code designed to disrupt or damage the Services.
• Bypass or attempt to bypass the Services' security measures, encryption, or access controls.
• Reverse-engineer, disassemble, or decompile any part of the Services other than where such rights are expressly protected by applicable law.
• Share your invite code or invitation email with anyone other than the co-parent or Family Circle member you intend to link with.

5. User Content & Ownership

• Your Content: You retain ownership of all data, photos, documents, and messages you upload to the Services ("User Content").
• License: You grant kinnly a limited, non-exclusive, royalty-free, worldwide license to host, store, transfer, and display your User Content solely to the extent necessary to provide the Services to you and your linked family members.
• Privacy & Access: We do not monitor your family's private communications, photos, or documents, except as required by law or to investigate terms violations.

6. Account Termination & Data Deletion

• Termination by You: You can terminate your account and delete your data at any time using the in-app Delete my account option. Because your account may belong to multiple families, the specific deletion behavior for each family depends on whether you are the sole parent on that family or have a linked co-parent — please see Section 5 of the Privacy Policy for the full description.
• Termination by Us: We reserve the right to suspend or terminate your account if you violate these Terms, or if we discontinue the Services.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. KINNLY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINNLY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in the app or by email, and we will update the "Effective Date" at the top. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
